Effective for the Cue website, the Cue mobile application, and all purchases of Cue products.

1. Introduction

This Privacy Policy describes how Sottung Labs, LLC, doing business as Shoot With Cue ("Company," "Cue," "we," "us," or "our"), collects, uses, and shares personal information when you visit shootwithcue.com (the "Site"), use the Shoot With Cue mobile applications (the "Apps"), or purchase products from us (collectively, the "Services"). By using the Site, the Apps, or the Services, you agree to the collection and use of information in accordance with this Privacy Policy.

Company is based in the Commonwealth of Virginia, United States. If you are accessing the Services from outside the United States, your information may be transferred to, stored, and processed in the United States.

Effective August 7, 2026, the Services are operated by Sottung Labs, LLC. Personal information previously collected by Nathan Sottung Photography, LLC in connection with the Services was transferred to Sottung Labs, LLC as part of that change, consistent with Section 4.3 (Business Transfers).

2. Information We Collect

2.1 Information You Provide Directly

When you place an order, create an account, contact us, or sign up for communications, we collect information you voluntarily provide, which may include:

  • name;

  • email address;

  • billing address and other transaction details;

  • communications you send to us, including support requests and feedback.

2.2 Payment Information

Payments made through the Site are processed by our third-party payment processor, Stripe, Inc. We do not store full payment card numbers on our systems. Payment card data is collected and processed directly by Stripe in accordance with its own privacy policy and applicable PCI-DSS standards. We receive only limited transaction data, such as the last four digits of the card, the card brand, and the transaction confirmation. Purchases made through the Apps are processed by Apple or Google (see Section 11).

2.3 Information Collected Automatically

When you visit the Site, we and our service providers may automatically collect certain information about your device and browsing activity, including:

  • IP address and general location derived from it;

  • browser type, operating system, and device identifiers;

  • pages visited, time spent on pages, and referring URLs;

  • cookies and similar tracking technologies (see Section 6).

2.4 Information from Third Parties

We may receive information from third-party services that help us operate the Site and Services, including our website host (Squarespace), our payment processor (Stripe), and any email or analytics platforms we use from time to time.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • to process orders, deliver digital products, and send order confirmations and receipts;

  • to provide customer support and respond to inquiries;

  • to operate, maintain, and improve the Site and Services;

  • to send transactional communications related to your purchase;

  • to send marketing communications, where you have opted in (you can unsubscribe at any time);

  • to detect, investigate, and prevent fraud, abuse, or violations of our terms;

  • to comply with legal obligations, respond to lawful requests, and enforce our agreements.

4. How We Share Your Information

We do not sell your personal information. We share information only in the limited circumstances described below:

4.1 Service Providers

We share information with third-party service providers who perform services on our behalf, including website hosting (Squarespace), payment processing (Stripe), email delivery, analytics, and, for the Apps, crash reporting (Sentry; see Section 11.7). These providers are authorized to use your information only as necessary to provide services to us.

4.2 Legal Requirements

We may disclose information if required to do so by law, subpoena, court order, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others, to investigate fraud, or to respond to a government request.

4.3 Business Transfers

If Company is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will provide notice of any such change in ownership or control of your personal information.

5. Data Retention

We retain personal information for as long as necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Order records are typically retained for a minimum of seven (7) years to satisfy tax, accounting, and audit requirements. You may request deletion of your information as described in Section 7, subject to our legal retention obligations.

6. Cookies and Tracking Technologies

The Site uses cookies and similar technologies to operate, secure, and improve the Site. Cookies are small data files stored on your device. We use: essential cookies, required for the Site and checkout to function; analytics cookies, to understand how visitors use the Site and improve it; preference cookies, to remember settings such as language or region. Most browsers allow you to refuse or delete cookies through your browser settings. If you disable essential cookies, parts of the Site, including checkout, may not function correctly.

7. Your Rights and Choices

7.1 Access, Correction, and Deletion

You may request to access, correct, or delete personal information we hold about you by contacting us at hello@shootwithcue.com. We will respond within the timeframes required by applicable law. We may need to verify your identity before processing certain requests.

7.2 Virginia Residents (VCDPA)

If you are a resident of the Commonwealth of Virginia, you have the right under the Virginia Consumer Data Protection Act to: (a) confirm whether we are processing your personal data; (b) access your personal data; (c) correct inaccuracies; (d) delete your personal data; (e) obtain a portable copy of your personal data; and (f) opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or certain profiling. We do not sell personal data and do not engage in targeted advertising. To exercise these rights, contact hello@shootwithcue.com. You may appeal a denial of your request by replying to our response.

7.3 California Residents (CCPA/CPRA)

If you are a resident of California, you have the right to: (a) know what personal information we collect, use, disclose, and (if applicable) sell; (b) request deletion of your personal information; (c) request correction of inaccurate personal information; and (d) opt out of the sale or sharing of personal information. We do not sell or share personal information for cross-context behavioral advertising. To exercise these rights, contact hello@shootwithcue.com.

7.4 EU and UK Residents (GDPR / UK GDPR)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the right under the GDPR or UK GDPR to access, rectify, erase, restrict, or object to the processing of your personal data, and to data portability. The legal bases on which we process your data include performance of a contract (to fulfill your order), legitimate interests (to operate and improve the Site), consent (where required, such as for marketing emails and App diagnostics), and compliance with legal obligations. To exercise these rights, contact hello@shootwithcue.com. You also have the right to lodge a complaint with your local data protection authority.

7.5 Marketing Communications

If you receive marketing emails from us, you can unsubscribe at any time using the link at the bottom of any marketing email or by contacting us. Transactional emails related to your order will continue regardless of marketing preferences.

8. Data Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information from unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

9. Children's Privacy

The Site and Services are not directed to individuals under the age of 16. We do not knowingly collect personal information from children under 16. If we learn that we have collected personal information from a child under 16 without verifiable parental consent, we will delete that information promptly. 10. International Data Transfers

Company is based in the United States. If you access the Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country. By using the Services, you consent to such transfer.

11. The Shoot With Cue Mobile Applications

This section describes our data practices for the Shoot With Cue mobile applications (the "Apps"), which differ from those for the Site because the Apps work without an account or a server, and the content you create in them never leaves your device unless you choose to send a diagnostic report.

11.1 On-Device Data

Content you create or manage in the Apps — including your contact card, the images you add, pose categories, notes, and settings — is stored locally on your device. We do not collect, transmit, or have access to this content.

When you add an image from your photo library, the App keeps a full-resolution copy inside the App so the image remains available if you later remove it from your library. You can delete it from the App at any time.

11.2 Photo Library Access

With your permission, the Apps access the photos you specifically select so they can be prepared and written to your camera's memory card. These images are processed entirely on your device and are not uploaded to us or any third party. You can change photo-access permissions at any time in your device settings.

11.3 Memory Card Access

To write to a camera memory card, the App asks you to choose the card in the system file picker. The App then reads the folder and file listing of that card, and the identifying details of a small number of your photographs on it, so it can decide where it may safely write and confirm that the card has not changed. This reading happens entirely on your device. The App does not copy, transmit, or retain your photographs from the card. Your memory card's folder and file listing is never sent to us.

11.4 Camera Identity and Serial Numbers

To make the files it writes display on your camera, the App reads identifying information from a setup photograph you take with your camera — including the camera make, model, and its serial numbers — and stores that information on your device with your saved camera. The App writes that information into the files it places on your memory card, because cameras use it to recognize files as their own. Your camera's serial number is shown to you in the App. It is stored on your device only, is masked in the App's own records, and is never included in any diagnostic report.

11.5 Free Loads

The App records how many free loads you have used. This count is stored in your device's secure storage (the Keychain) and persists if you delete and reinstall the App. It is not sent to us. It contains no personal information.

11.6 Purchases

In-app purchases are sold and processed by Apple through the App Store or by Google through Google Play, depending on your device. We do not receive or store your payment card details. Apple and Google provide us only with limited, aggregated transaction reporting. Your purchases are also governed by the applicable store's terms and privacy policy.

11.7 Crash and Diagnostic Reports (Opt-In)

The Apps can send crash reports and limited diagnostic information to us, through Sentry, a third-party crash-reporting service, to help us find and fix problems. This is off unless you turn it on. You are asked once during setup, and you can change your choice at any time in the App's settings. If you leave it off, nothing is sent.

If you turn it on, the App may send:

  • crash reports, when the App stops unexpectedly;

  • camera-compatibility results — the make and model of your camera and whether it displayed the files the App wrote — when you confirm a result in the App;

  • if a screen in the App repeats itself, the name of that screen and how many times it repeated;

  • with each report, the device model, operating-system version, App version, and build identifier.

Before anything is sent, the App removes names, contact details, memory card contents, and camera serial numbers. Your contact card, your images, your notes, the listing of your memory card, and the contents of any file are never sent.

Because a report is sent over the internet, Sentry receives the network address it was sent from; we do not use that address to identify you. Reports are used solely to improve the Apps' stability and compatibility, are not linked to your identity, and are not used for advertising or tracking.

11.8 Time and Clock Information

The App shows your device's current time so you can set your camera's clock, and compares the time recorded in your setup photograph with your device's clock to tell you if they differ. This comparison happens on your device. The App does not contact any time server and does not send time information to us.

11.9 App Store Services

The Apps use standard components provided by Apple and Google to handle purchases. These components are operated by Apple and Google under their own privacy policies and may send them technical and diagnostic information about their own operation. We do not receive that information, and it is not used by us for advertising or tracking.

11.10 No Tracking or Advertising

The Apps contain no advertising and do not track you across other apps or websites. Apart from the opt-in diagnostics described in Section 11.7 and the store components described in Section 11.9, the Apps include no third-party analytics and make no network requests.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The version posted on this page, identified by the "Last revised" date at the top, governs our practices as of that date. Material changes will be communicated by updating the date and, where appropriate, by additional notice such as a Site banner or email. Your continued use of the Site, the Apps, or the Services after changes take effect constitutes acceptance of the revised Privacy Policy.
